This Child Safety Standards Policy is incorporated by reference into the Planogram, LLC, d/b/a “Planoly” (“Planoly”, “Company”, “we”, “our”, or “us”) Terms of Use and provides guidelines for Creator Content and safety measures for children, interactions with children, and you, including behaviors that are prohibited on Planoly Services. Please review this Child Safety Standards Policy. By using our Services, you agree to be bound by this Child Safety Standards Policy and abide by it at all times, including but not limited to its application to your Creator Content, Public Posts, and any other use of the Services. Defined terms used herein and not otherwise defined have the meanings set forth in the Terms of Use.
Prohibition of Child Sexual Abuse and Exploitation
- Planoly prohibits and has a zero-tolerance policy against Child Sexual Abuse and Exploitation (“CSAE”).
- Creator Content, message content, links to content, and/or any visual depiction that features, shares, promotes, or facilitates the sexual exploitation or depicts sexually explicit conduct involving a person under the age of 18 (collectively, Child Sexual Abuse Material or “CSAM”) is strictly prohibited. CSAM includes this type of content and/or links to such CSAM in media, text, illustrations, computer generated images. You may not engage or attempt to engage a child in a sexually explicit conversation or attempt to obtain sexually explicit media from a child. When we become aware of content depicting or promoting CSAE, we will remove the responsible account and report it to the appropriate authorities.
- We understand that you might want to talk about and share images of your children. Any discussions about children must remain appropriate, relevant, and lawful. In addition, if you decide to include photos of children in your Creator Content, children must be completely clothed and should not appear alone in the image to avoid unlawful manipulation. This includes any photos from your childhood.
Planoly Takes Action Against Child Sexual Abuse Material
- Planoly is committed to reviewing materials that are flagged as CSAM, explicit conversations with a child, any other media containing similar materials, and/or any content that could be considered CSAM. If Planoly finds that there is CSAM on any of its Services, it will remove such material in accordance with our Terms of Use.
- In addition to removing any CSAM about which Planoly has actual knowledge, Planoly will report all information relating to CSAM to the appropriate authorities, including law enforcement.
- Violation of this Child Safety Standards Policy will result in your immediate removal from all of our Services in accordance with our Terms of Use.
Compliance with Child Safety Laws
- Planoly is dedicated to complying with all applicable child safety laws and regulations. In the event that Planoly has knowledge of CSAM on its Services, it will work with the applicable law enforcement authorities and cooperate with investigations of such materials.
- Planoly’s process for handling confirmed CSAM is as follows:
- Removing the material immediately from its Services.
- Banning the individual who posted the CSAM from use of the Services.
- Reporting all confirmed incidents of CSAM to the National Center for Missing and Exploited Children.
- Reporting all confirmed incidents of CSAM to national, state, and local authorities, including law enforcement as required.
- Cooperating in further investigations as directed by relevant national, state, and local authorities.
- Coordinating internally to ensure that Planoly’s review of Creator Content and other materials on its Services is effective and efficient for flagging CSAM.
User Feedback
- You are encouraged and required to report CSAM on Planoly’s Services, including other feedback and concerns related to CSAM, to leadership@planoly.com.
- Planoly regularly monitors this channel of communication and certifies that all feedback related to CSAM will be investigated and reviewed.
Child Safety Point of Conduct
- Planoly has an individual designated as its point of contact for all potential notifications of CSAM and child sexual abuse and exploitation content found on its Services.
- This individual can be reached at leadership@planoly.com for all feedback concerning CSAM and child sexual abuse and exploitation content.
- Planoly has designated this contact specially for this Child Safety Standards Policy and has the authority to speak to the enforcement, review procedures, and to take further action, if required.
